Back Country Tours Policy, Terms and Conditions


 

GUIDED TOUR POLICY AND TERMS

 

Definitions of terms used in this document:
GUIDED TOUR: Includes Professional Guided Services while using our trails.
RENTAL UNIT on a GUIDED TOUR: ATV, Snowmobile or Personal Watercraft (Jet-Ski)
OPERATOR:  Person Driving a RENTAL UNIT on a GUIDED TOUR.
PASSENGER: Passenger of RENTAL UNIT on a GUIDED TOUR (not driving the machine)
RESERVATION DEPOSIT: Deposit charged to Credit Card holder to reserve a scheduled Guided Tour.
SECURITY DAMAGE DEPOSIT: Pre-Authorized held deposit charged to Credit Card Holder and then released when RENTAL UNIT on a GUIDED TOUR is returned in good standing, not damaged.

 

 

Operator Safety Terms and Release:

  1. Operator must be 13 years of age or older to drive a RENTAL UNIT ON A GUIDED TOUR on a GUIDED Tour.
  2. All Operators must sign a Waiver of All Claims, Release from Liability, Assumption of Risk and Indemnity Agreement.
  3. Operations under 19 years of age must have their legal guardian/parent sign a Children’s Waiver of All Claims, Release from Liability, Assumption of Risk and Indemnity Agreement.
  4. Operator must wear proper safety equipment when operating RENTAL UNIT on a GUIDED TOUR.
  5. Operator must be the ONLY operator of this RENTAL UNIT on a GUIDED TOUR.
  6. Operator agrees there are to be NO MINORS operating this RENTAL UNIT on a GUIDED. TOUR.
  7. Operator agrees that he/she will not consume alcohol, drugs, or ingest any substances that could/would adversely   affect my ability to safely/successfully operate the RENTAL UNIT on a GUIDED TOUR.
  8. Operator agrees to avoid driving in any areas where the Operator believes that he does not have the skill to operate in.
  9. Operator agrees that he/she have been thoroughly briefed on how to safely operate the RENTAL UNIT on a GUIDED TOUR and/or have established themselves as competent to operate the RENTAL UNIT on a GUIDED TOUR .

 

 

Reservation Deposit:

  1. For Individuals or Families, to reserve your RENTAL UNIT on a GUIDED TOUR, Operator agrees to pay a 50% non-refundable booking deposit charged on his/hers credit card to confirm their reservation.
  2. For Corporate Guided Tours to reserve your RENTAL UNIT on a GUIDED TOUR, Operator agrees to pay a 50% non-refundable booking deposit charged on his/hers credit card to confirm their reservation.
  3. For Stag Parties, to reserve your RENTAL UNIT on a GUIDED TOUR, Operator agrees to pay a 50% non-refundable booking deposit charged on his/hers credit card to confirm their reservation
  4. Operator agrees that there are NO REFUNDS on reservation deposits, but if there should be a cancellation the Operator can use his/her reservation deposit and reschedule the RENTAL UNIT on a GUIDED TOUR at later date and is valid for 1 year.

 

 

RENTAL UNIT on a GUIDED TOUR Schedule, Cancellation and Late Fees:

  1. Operator agrees to arrive 15 minutes earlier than scheduled Guided Tour Time.
  2. Operator agrees that there are no refunds/discounts if the Operator is late arriving for his/hers GUIDED TOUR.
  3. Operator agrees that he/she will be charged a $50 processing fee if he/she cancels their reservation 2 weeks or more in advance.
  4. Operator agrees to pay the remain balance owing if  he/she CANCELS the GUIDED TOUR reservation  2 WEEKS or less than the scheduled GUIDED TOUR date.  The Operators credit card will automatically be charged the remaining owning balance.

 

 

RENTAL UNIT on a GUIDED TOUR Condition Terms, Damages and Release:

  1. Operator agrees to a pre-authorization security damage deposit charge on credit card if the group is 6 people or Less on the GUIDED in the amount of $100. The security damage deposit is returned to the Operator once the RENTAL UNITS on the GUIDED TOUR is returned to Back Country Tours Inc. in the same condition it was sent out.
  2. Operator agrees to a pre-authorization security damage deposit charge on credit card if the group is 6 people or More on the GUIDED in the amount of $300. The security damage deposit is returned to the Operator once the RENTAL UNITS on the GUIDED TOUR is returned to Back Country Tours Inc. in the same condition it was sent out.
  3. Operator agrees to check-in (return) the RENTAL UNITS on a GUIDED TOUR in the EXACT same condition it was in upon check- out (pickup). Note: acceptable tire tread-wear is expected, however excessive wear / damage will be charged.
  4. Operator agrees that ANY and ALL damages/losses sustained to the RENTAL UNIT  during the GUIDED TOUR are to be paid for by the Operator.
  5. Operator agrees to pay for damages/losses/penalties for the (RENTAL UNIT on a GUIDED TOUR) out of his/hers security deposit and if the damages exceed the security deposit then his/hers credit card will automatically be charged the additional cost.
  6. Operator agrees that Back Country Tours Inc. will hold his/hers security deposit no less than 2 days and no later than 7 days after check-in date if there are no damages.

 

 

Refund Policy Terms and Release:

  1. Operator agrees that he/she cannot get a refund on his/hers reservation deposit. In the event the   reservation is cancelled and the Operator notify Back Country Tours Inc. 2 weeks or more in advance, in which case it will be subject to a $85 cancellation-fee. If the reservation is cancelled 2 weeks or less in advance then the Operator will be subject to paying the remaining balance owing, this will be automatically charged to the Operator’s credit card.
  2. Operator agrees that reservations made that fall on a holiday are non-refundable.
  3. Operator agrees that if weather adversely affects the ability to utilize the RENTAL UNIT on a GUIDED TOUR, Back Country Tours Inc. is under NO obligation to issue a refund or discount.
  4. If the Operator is not satisfied with the performance of the RENTAL UNIT on a GUIDED TOUR, he/she does not get a refund. These are respected and well-maintained RENTAL UNITs on a GUIDED TOURS, so unless a mechanical failure occurs there’s no logical reason to be displeased with its performance, and therefore no refund will be issued.
  5. If the Operator is not satisfied with the overall experience of off-road trails / activities, Back Country Tours Inc. is in no way responsible.
  6. If the Operator gets injured during the rental period and has to sit out while there is more GUIDED TOUR time already paid for, Back Country Tours Inc. is not responsible and under no obligation to issue any refunds.

 

 

Recovery Policy Terms and Release

  1. If RENTAL UNIT on a GUIDED TOUR becomes disabled and is no longer mobile as a result of operator error or trail conditions (accident, collision, flat tire(s), out of gas, etc.), Operator agrees to pay $100 per hour for recovery of disabled RENTAL UNIT on a GUIDED TOUR.
  2. If RENTAL UNIT on a GUIDED TOUR becomes disabled and is no longer mobile as a result of equipment failure (mechanical failures) not a result of operator error, Back Country Tours Inc. will cover recovery fees.
  3. If RENTAL UNIT on a GUIDED TOUR is towable and the Operator is on Tour with a Guide, the Operator is welcome to tow the disabled RENTAL UNIT on a GUIDED TOUR back to the rental facility. However, if any damages are done to the RENTAL UNIT on a GUIDED TOUR as a result of improper towing gear or being towed improperly (bent bumpers, bent racks, etc.) damages will be deducted from the security deposit.
  4. If RENTAL UNIT on a GUIDED TOUR is towable and the Operator is on Tour with a Guide, the Tour Guide is welcome to tow the disabled RENTAL UNIT back to the rental facility.  Recovery Charges are $100/Hour.

  1. Renter must be 19 years of age.
  2. Renter must wear proper safety equipment when operating RENTAL UNIT.
  3. Renter must be the ONLY operator of this RENTAL UNIT.
  4. Renter agrees there are to be NO MINORS operating this RENTAL UNIT.
  5. Renter agrees that he/she will not consume alcohol, drugs, or ingest any substances that could/would adversely   affect my ability to safely/successfully operate the RENTAL UNIT.
  6. Renter agrees to operate the RENTAL UNIT ONLY on areas that are legal by Ontario provincial law.
  7. Renter agrees to NOT TRESPASS on any property that the Renter is not allowed to operate the RENTAL UNIT on.
  8. Renter agrees to avoid driving in any areas where the Renter believes that he does not have the skill to operate in.
  9. Renter agrees that he/she have been thoroughly briefed on how to safely operate the RENTAL UNIT and/or have established themselves as competent to operate the RENTAL UNIT .

 

 

Reservation Deposit:

  1. To reserve your RENTAL UNIT, Renter agrees pay a 50% non-refundable booking deposit charged on his/hers credit card to confirm their reservation.
  2. Renter agrees that there are NO REFUNDS on reservation deposits, but if there should be a cancellation the Renter can use his/her reservation deposit and reschedule the RENTAL UNIT at later date and is valid for 1 year.

 

 

Rental Unit Schedule, Cancellation and Late Fees:

  1. Renter agrees that check-out time is no earlier than 9:00am on specified check-out date unless otherwise authorized by Back Country Tours Inc.
  2. Renter agrees that check-in time is no later than 5:00 pm on specified check-in date unless otherwise authorized by Back Country Tours Inc.
  3. Renter agrees that there are no refunds/discounts if the Renter is late picking up the RENTAL UNIT.
  4. Renter agrees that he/she will be charged a $100 late fee if RENTAL UNIT is brought back within 2 hours late on check-in date and time.
  5. Renter agrees that he/she  will be charged a $300 late fee if RENTAL UNIT is brought back beyond 2 hours late on check-in date and time.
  6. Renter agrees that Back Country Tour Inc. will take legal action and seek prosecution if RENTAL UNIT is over 24 hours later than specified check-in date and time.
  7. Renter agrees that he/she will be charged a $50 processing fee if he/she cancels their reservation 2 weeks or more in advance.
  8. Renter agrees to pay the remain balance owing if  he/she CANCELS the RENTAL UNIT reservation  2 WEEKS or less than scheduled RENTAL UNIT date.  The Renters credit card will automatically be charged the remaining owning balance.

 

 

Rental Unit Condition Terms, Damages and Release:

  1. Renter agrees to a pre-authorization security damage deposit charge on credit card for each RENTAL UNIT rented from Back Country Tours Inc. in the amount of $2000. The security damage deposit is returned to the Renter once the RENTAL UNIT is returned to Back Country Tours Inc. in the same condition it was rented out.
  2. Renter agrees to check-in (return) the RENTAL UNIT in the EXACT same condition it was in upon check- out (pickup). Note: acceptable tire tread-wear is expected, however excessive wear / damage will be charged.
  3. Renter agrees that ANY and ALL damages/losses sustained to the RENTAL UNIT during the rental period are to be paid for by the renter.
  4. Renter agrees to pay for damages/losses/penalties for the (RENTAL UNIT) out of his/hers security deposit and if the damages exceed the security deposit then his/hers credit card will automatically be charged the additional cost.
  5. Renter agrees that Back Country Tours Inc. will hold his/hers security deposit no less than 2 days and no later than 7 days after check-in date if there are no damages.
  6. Renter agrees that he/she will NOT submerge the RENTAL UNIT in rivers, mud-holes, swamps, water-basins or any other body of water beyond the RENTAL UNIT’s designed capabilities. If upon inspection it is obvious the RENTAL UNIT has been submerged, He/she forfeit $500 of security deposit to Back Country Tours Inc.
  7. Renter agrees to return the RENTAL UNIT as clean as it was when it was checked-out. Failure to do so will result in $35(RENTAL UNIT) cleaning fee unless otherwise stated by the rental facility.
  8. Renter agrees to return the RENTAL UNIT with same amount of gas as it had when it was checked-out. Failure to do so will result in fuel charges in the amount of $3 per litre  which will automatically be deducted from your security deposit.
  9. Renter agrees to operate RENTAL UNIT on licensed Off-Road-Vehicle areas and legal property / roadways only. If RENTAL UNIT is rendered inoperable, regardless of who’s at fault, on any property other than a mapped and licensed Off-Road-Vehicle area, the renter will be charged any and all recovery costs to bring the RENTAL UNIT back to rental facility.

 

 

Refund Policy Terms and Release:

  1. Renter agrees that he/she cannot get a refund on his/hers reservation deposit. In the event the   reservation is cancelled and the Renter notify Back Country Tours Inc. 2 weeks or more in advance, in which case it will be subject to a $85 cancellation-fee. If the reservation is cancelled 2 weeks or less in advance then the Renter will be subject to paying the remaining balance owing, this will be automatically charged to the Renter’s credit card.
  2. Renter agrees that reservations made that fall on a holiday are non-refundable.
  3. Renter agrees that if weather adversely affects the ability to utilize the RENTAL UNIT, Back Country Tours Inc. is under NO obligation to issue a refund or discount.
  4. Renter agrees that if the RENTAL UNIT fails in use (NOTE: MECHANICAL FAILURE NOT CAUSED BY OPERATOR), the Renter is REQUIRED to contact Back Country Tours Inc. immediately. Failure to make contact will delay or forfeit any possible refunds. Depending on availability, Back Country Tours Inc. will then replace the RENTAL UNIT and issue a full day’s refund for the day the failure occurs. If the RENTAL UNIT is disabled and cannot be replaced due to lack of availability, a refund for the day of failure and the remainder of the rental period will be issued. A coupon for a 25% discount for a RENTAL UNIT will also be issued, VALID FOR 1 YEAR.
  5. If the Renter is not satisfied with the performance of the RENTAL UNIT, he/she do not get a refund. These are respected and well-maintained RENTAL UNITS, so unless a mechanical failure occurs there’s no logical reason to be displeased with its performance, and therefore no refund will be issued.
  6. If the Renter is not satisfied with the overall experience of off-road trails / activities, Back Country Tours Inc. is in no way responsible.
  7. If the Renter gets injured during the rental period and hasto sit out while there is more rental time already paid for, Back Country Tours Inc. is not responsible and under no obligation to issue any refunds.

  1. If RENTAL UNIT becomes disabled and is no longer mobile as a result of operator error or trail conditions (accident, collision, flat tire(s), out of gas, etc.), Renter agrees to pay $100 per hour for recovery of disabled RENTAL UNIT.
  2. If RENTAL UNIT becomes disabled and is no longer mobile as a result of equipment failure (mechanical failures) not a result of operator error, Back Country Tours Inc. will cover recovery fees.
  3. If RENTAL UNIT becomes disabled and is no longer mobile on any trail system, posted recovery fees apply regardless of what caused RENTAL UNIT to become immobilized. This is due to the fact that it is very difficult to locate the disabled RENTAL UNIT on unmapped territory.
  4. If RENTAL UNIT is towable and the Renter is with a friend or friends with another UNIT with towing capabilities, the Renter is welcome to tow the disabled RENTAL UNIT back to the rental facility. However, if any damages are done to the RENTAL UNIT as a result of improper towing gear or being towed improperly (bent bumpers, bent racks, etc.) damages will be deducted from the security deposit.
